Terms of Service

1. Eligibility

You must be at least 16 years old and capable of forming a binding contract to use the Service. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Description of Service

Tarvio allows you to collect text and video testimonials from your customers via shareable links, manage and approve those testimonials, and embed them on your website using a widget.

The Service is offered on a Free tier (up to 5 approved testimonials, 1 workspace), a Pro tier (unlimited testimonials, up to 2 workspaces) at $12/mo, and an Agency tier (unlimited testimonials, up to 10 workspaces) at $29/mo. Prices are as displayed at checkout. We reserve the right to change pricing with 30 days' notice to existing subscribers.

3. Accounts

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at legal@tarvio.com if you suspect unauthorized access.
• You may not share accounts or create accounts on behalf of others without permission.

4. Subscriptions & Payment

• Pro subscriptions are billed monthly in advance via Stripe.
• All fees are non-refundable except where required by law or at our sole discretion.
• If a payment fails, we may downgrade your account to the Free tier after a grace period.
• You may cancel your subscription at any time from your account settings. Access to Pro features continues until the end of the current billing period.
• We may change subscription prices with 30 days' notice sent to your registered email. Continued use after notice constitutes acceptance.

5. Acceptable Use

You agree not to use the Service to:

• Collect testimonials without the knowledge or consent of the submitters
• Post or distribute false, misleading, defamatory, or fraudulent content
• Impersonate any person or entity
• Send spam or unsolicited communications
• Upload malware, viruses, or any harmful code
• Violate any applicable law or regulation, including privacy laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Resell, sublicense, or commercially exploit the Service without our written consent

6. User Content

"User Content" means testimonials, media, and other material submitted to or through the Service.

• You retain ownership of User Content you upload.
• By submitting User Content you grant Tarvio a worldwide, royalty-free license to store, process, and display it as necessary to operate the Service.
• You are solely responsible for ensuring you have the right to collect and display testimonials from your customers.
• We may remove User Content that violates these Terms or applicable law without notice.

7. Intellectual Property

The Service, including its software, design, trademarks, and content (excluding User Content), is owned by Tarvio and protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service without our written consent.

8. Termination & Suspension

We may suspend or terminate your account at any time if we believe you have violated these Terms, with or without notice, at our sole discretion. You may terminate your account at any time from settings.

Upon termination: access to the Service ends immediately; your data will be deleted within 30 days except as required by law.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TARVIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold Tarvio and its officers, directors, and employees harmless from any claims, losses, or damages (including legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

12. Governing Law & Disputes

These Terms are governed by the laws of Germany, without regard to conflict of law principles. Any dispute shall first be attempted to be resolved by contacting us at legal@tarvio.com. If unresolved, disputes shall be submitted to the courts of Germany. If you are a consumer in the EU, you retain the benefit of mandatory consumer protection laws in your country of residence.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you by email or by posting a notice on the Service. Continued use after the effective date constitutes acceptance of the new Terms.
